Article 1 – Definitions

In these terms and conditions the following terms shall have the following meanings:

1.1. Its Jewellery : the company located at Steenweg 16, 4781 AP Moerdijk, registered with the Chamber of Commerce under number 96141239, trading under the name "Its Jewellery".

1.2. Customer : the natural person or legal entity who enters into an agreement with Its Jewellery.

1.3. Consumer : a customer being a natural person who does not act in the exercise of a profession or business.

1.4. Agreement : an agreement between Its Jewellery and the customer regarding the purchase of products via the webshop or otherwise.

1.5. Products : the jewellery and related items offered by Its Jewellery.

1.6. Reflection period : the period within which the consumer can exercise his right of withdrawal.

1.7. Right of withdrawal : the option for a consumer to cancel the distance contract within the cooling-off period.

Article 2 – Applicability

2.1. These general terms and conditions apply to all offers, orders, and agreements between Its Jewellery and the customer.

2.2. Deviations from these conditions are only valid if agreed in writing.

2.3. If one or more provisions of these terms and conditions are null and void or are annulled, the remaining provisions will remain in full force.

Article 3 – Offer and Agreement

3.1. All offers from Its Jewellery are non-binding and valid while supplies last.

3.2. The agreement is concluded upon acceptance of the offer and its confirmation by Its Jewellery by email.

3.3. Its Jewellery is entitled to refuse orders or impose additional conditions.

Article 4 – Prices and Payment

4.1. All prices are in euros and include VAT, unless stated otherwise.

4.2. Any shipping costs will be listed separately at checkout.

4.3. Payment must be made via the payment methods offered on the website prior to delivery.

4.4. In the event of late payment, Its Jewellery reserves the right to suspend delivery.

Article 5 – Delivery and Execution

5.1. Delivery will take place at the address specified by the customer.

5.2. The delivery time is a maximum of 30 days, unless otherwise agreed.

5.3. If delivery is delayed, the customer will be notified in a timely manner.

5.4. The risk of damage and/or loss of products rests with Its Jewellery until the moment of delivery.

Article 6 – Right of withdrawal

6.1. The consumer has the right to cancel the agreement within 14 days after receiving the product without giving any reason.

6.2. During the cooling-off period, the consumer will handle the product and packaging with care.

6.3. The consumer must return the product in its original condition within 14 days of cancellation.

6.4. The costs for return shipping are borne by the consumer, unless otherwise agreed.

6.5. The right of withdrawal does not apply to:

a. Products that are custom-made or personalized.

b. Hygienically sealed products where the seal has been broken.

Article 7 – Warranty and Liability

7.1. Its Jewellery products have a 6-month warranty, unless stated otherwise.

7.2. The warranty is void in the event of improper use or damage caused by your own actions.

7.3. Its Jewellery is only liable for direct damage that can be demonstrably attributed to it.

7.4. Any liability is limited to the amount of the order in question.

Article 8 – Complaints procedure

8.1. Complaints about the performance of the agreement must be submitted fully and clearly described to info@itsjewellery.nl within 7 days of discovery.

8.2. Complaints will be answered within 14 days of receipt.

8.3. If the complaint cannot be resolved by mutual agreement, a dispute arises that is subject to dispute resolution.

Article 9 – Disputes and Applicable Law

9.1. All legal relationships in which Its Jewellery is a party are exclusively governed by Dutch law.

9.2. Disputes will be submitted exclusively to the competent court in [place name], unless mandatory law prescribes otherwise.

Article 10 – Intellectual Property

10.1. All intellectual property rights relating to the products, photographs, texts, and designs of Its Jewellery belong to Its Jewellery or its licensors.

10.2. It is not permitted to copy, distribute, or otherwise use materials from Its Jewellery without written permission.
